Terms and conditions of use
These terms govern access to and use of LIKSOFT Pro Messaging, a professional platform for SMS, WhatsApp and email communications.
Last updated: April 28, 2026
1. Scope and acceptance
By creating an account, signing an order form or using the platform, the customer accepts these terms. A signed contract, order form or specific service terms prevail if they conflict with this page.
The service is intended for professionals and organizations able to enter into binding agreements. Account holders are responsible for authorized users and for keeping account information current.
2. Accounts and access security
- Provide accurate registration, billing and verification information.
- Protect passwords, API keys, backup codes and administrator access.
- Notify LIKSOFT promptly through the official website if access may have been compromised.
- Use least-privilege access and revoke credentials that are no longer needed.
3. Lawful messaging and recipient consent
The customer determines the recipients, content, timing and purpose of its messages. It must have a valid legal basis and all required prior consent before direct marketing, keep appropriate proof, honor opt-outs and respect applicable marketing, consumer, telecommunications and data-protection rules. Article 26 of Togolese Law No. 2019-014 prohibits direct marketing without prior consent.
Prohibited use includes fraud, impersonation, harassment, unlawful or misleading content, malicious code, credential theft, prohibited goods or services, unsolicited bulk traffic and attempts to bypass provider or network safeguards.
4. Sender IDs, domains and channels
Sender IDs, WhatsApp business assets, sending domains and other identities may require documents, verification and approval by LIKSOFT, carriers or channel providers. Approval is not guaranteed and may later be withdrawn by a provider or authority.
The customer may use only names, domains, numbers and brands it is authorized to represent. It remains responsible for the accuracy and legitimacy of submitted evidence.
Customer email can be sent through the LIKSOFT Pro Messaging API or through branded SMTP at email-smtp.likbusiness.com. SMTP credentials are issued in the portal and can be revoked.
5. Credits, prices and billing
Prepaid credits are applied to eligible platform usage according to the rate shown or contract in force when the service is used. Provider, country, network, channel, tax or exchange-rate changes may affect future prices after notice through the service or commercial documents.
Credits are not legal tender and are not redeemable for cash except where required by law or expressly agreed in writing. The customer must review invoices and usage records promptly and report a substantiated discrepancy.
6. Delivery and third-party networks
Message transmission relies on telecom operators, internet providers, email services, WhatsApp or Meta infrastructure and other third parties. Queuing, filtering, delay, rejection, recipient-device state and provider outages may affect delivery.
LIKSOFT provides operational monitoring but does not guarantee that every message will be delivered, read or delivered within a fixed time unless a written service commitment says otherwise.
7. Suspension and termination
LIKSOFT may limit or suspend traffic when reasonably necessary to address security, fraud, unlawful use, unpaid amounts, provider requirements, excessive risk or material breach. When circumstances permit, the customer will be informed and given a reasonable opportunity to remedy the issue.
On termination, access may be disabled and remaining data handled under the contract, applicable retention duties and the privacy policy.
8. Intellectual property
LIKSOFT and its licensors retain rights in the platform, software, interfaces, documentation and branding. The customer retains rights in its content and grants only the rights needed to process and deliver it, secure the service and comply with law.
9. Liability
Each party remains responsible for its own acts, instructions and legal obligations. To the extent permitted by applicable law, neither party is liable for indirect or consequential loss that could not reasonably have been anticipated.
Any contractual limitation stated in an order form or signed agreement applies. Nothing excludes liability that cannot lawfully be limited, including liability arising from fraud or intentional misconduct.
10. Applicable law, changes and contact
Applicable Togolese law includes, where relevant, Law No. 2017-007 on electronic transactions and Law No. 2019-014 of October 29, 2019 on personal data protection. The competent forum and any additional governing-law terms are those stated in the customer’s signed commercial documents or otherwise determined by mandatory law.
These terms may be updated for legal, security or service changes. Material changes will be presented through an appropriate channel. Questions may be submitted to [email protected] or through the official LIKSOFT website.
